1. Agreement to these terms

These Terms of Use (“Terms”) are a legal agreement between you and Crayon Labs Inc (“Crayon,” “we,” “us,” or “our”). They govern your access to the Crayon website, game-building application, Arcade, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use Crayon on behalf of an organization, you confirm that you have authority to bind that organization, and “you” includes that organization.

2. Eligibility and accounts

You must be at least 13 years old and legally able to enter into these Terms. If you are under the age of majority where you live, you may use Crayon only with permission from a parent or legal guardian. A higher minimum age may apply where required by local law.

You agree to provide accurate account information, keep your credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account and may not sell, transfer, or share access in a way that compromises the Service.

3. The Service and beta features

Crayon lets you describe, generate, edit, play, publish, share, and export games and game assets. The Service is offered in beta, with a free starter allowance and paid plans described in section 4. Features may be experimental, incomplete, or change without notice, and generated games may contain errors or behave in unexpected ways.

We may add, remove, limit, or discontinue features to improve Crayon, protect users, or meet legal and operational needs. We do not promise that any feature, project format, or free offering will remain available forever. Please keep your own copies of content you cannot afford to lose.

4. Plans, credits and payment

Crayon runs on credits. Generating and editing games consumes credits from your balance. New accounts receive a one-time starter allowance of 150 credits, valid for 90 days. Paid options are shown in the app before you buy:

  • a monthly subscription at US $15 per month, which grants 1,500 credits at the start of each billing cycle and unlocks game export and priority support;
  • a one-off credit pack at US $5 for 300 credits, usable within 60 days of purchase.

Subscription credits are granted per cycle and do not roll over — an unused balance is not carried into the next month. You may cancel at any time; the cancellation takes effect at the end of the cycle you have already paid for, and the credits granted for that cycle remain usable until it ends. Prices are in US dollars and exclude any taxes that apply where you are.

Payments are processed by Stripe. We do not receive or store your full card details. You are responsible for keeping your payment method current and for all charges incurred on your account.

No refunds, returns, or exchanges. All purchases are final. We do not process refunds or returns for subscriptions, credit packs, unused or expired credits, or partial billing periods, and we do not offer credit for downtime, changes to the Service, or output you are unhappy with. If you no longer want to be billed, cancel before your next cycle. This does not affect any rights you have under consumer law that cannot be waived by agreement.

We may change prices, credit allowances, or what a credit buys. Changes to a recurring price take effect from your next billing cycle after we notify you, and your continued use of a paid plan after that point is your acceptance of the new price.

5. Your content

“User Content” means prompts, game ideas, project data, uploaded materials, generated assets you select or edit, titles, descriptions, feedback, and anything else you submit to the Service. As between you and Crayon, you keep ownership of your original User Content.

You give Crayon a worldwide, non-exclusive, royalty-free license to host, reproduce, process, adapt, display, and transmit User Content only as reasonably needed to operate, secure, maintain, and improve the Service; follow your instructions; and comply with law. This license lasts while your content is stored with us, plus a reasonable period for backups and legal compliance.

When you choose to publish User Content, you also allow Crayon to make it available through the Arcade and to display it in connection with operating and promoting Crayon. You can end this public license by unpublishing or deleting the content, subject to existing shares, cached copies, backups, and uses already made.

You are responsible for User Content and confirm that you have the rights and permissions needed to submit and use it. Do not upload confidential information or material that violates another person’s rights.

6. AI-generated output

Crayon uses automated and artificial-intelligence systems to create and edit games, visuals, code, text, and other output from your instructions (“Output”). You direct how Output is used and are responsible for reviewing it before publishing, distributing, or relying on it.

To the extent permitted by law, Crayon does not claim ownership of Output generated specifically for you. Because AI systems can produce similar or identical material for different users, Output may not be unique and we cannot guarantee that it is protectable, accurate, complete, or free from third-party rights. You must evaluate whether your use of Output is lawful and appropriate.

Crayon is an intermediary, not the author of your Output. The Service passes your instructions to automated and third-party model providers and returns what they produce. We do not choose your prompts, pre-screen, review, or monitor Output, and we do not verify whether it resembles or reproduces material owned by someone else. As between you and Crayon, you are solely responsible for the prompts you write, the references you upload, and the games you generate, publish, export, or distribute — and for making sure none of it infringes copyright, trademark, publicity, privacy, or any other right.

To the fullest extent permitted by law, Crayon is not liable for any claim, demand, loss, or proceeding arising from Output or from content you supply, including claims of intellectual-property infringement, and you will not hold us responsible for them. If you believe something on Crayon infringes your rights, write to aniket@usecrayon.ai with enough detail to identify the material and we will review it and remove it where appropriate.

7. Acceptable use

You may not use the Service to:

  • break the law, facilitate harm, or violate another person’s rights;
  • create, upload, or distribute content that is fraudulent, unlawfully threatening, exploitative, sexually abusive, or that sexualizes minors;
  • infringe intellectual property, privacy, publicity, or other legal rights;
  • spread malware, phishing, spam, or code intended to damage or secretly access systems;
  • harass people, impersonate others deceptively, or misrepresent affiliation with Crayon;
  • bypass safety controls, access restrictions, usage limits, or account protections;
  • probe, scrape, reverse engineer, or overload the Service except where applicable law expressly permits it; or
  • use Output or the Service to make high-impact decisions about a person in areas such as employment, housing, credit, education, insurance, legal services, or healthcare.

We may investigate suspected violations and remove content or restrict access when reasonably necessary to protect the Service, users, or others.

8. Publishing and third-party services

Published games can be viewed, played, linked, indexed, or shared by others. You decide what to publish and remain responsible for the game, its content, and any notices or age ratings it may require. We may remove or limit published content that violates these Terms or creates legal, safety, or technical risk.

Crayon may link to or let you export content to third-party services and game portals. Their rules, review standards, fees, and privacy practices apply separately. We do not control and are not responsible for third-party services, content, or availability.

9. Crayon ownership and feedback

Crayon and its licensors own the Service, including its software, design, brand, logos, documentation, and technology, excluding User Content. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service as permitted here. They do not transfer any ownership of the Service to you.

If you send us ideas or feedback, you allow us to use them without restriction or payment. This does not give us ownership of your games or other User Content.

10. Suspension and termination

You may stop using Crayon at any time. We may suspend or terminate access, remove content, or limit features if you violate these Terms, create risk or legal exposure, fail to secure your account, or if operating the Service is no longer commercially or technically practical. When reasonable, we will provide notice and an opportunity to export content.

Provisions that by their nature should survive termination will survive, including those concerning ownership, disclaimers, liability, disputes, and accrued obligations.

11. Disclaimers and limitation of liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Crayon disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Crayon and its officers, employees, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to the Service.

To the fullest extent permitted by law, Crayon’s total liability for all claims relating to the Service will not exceed the greater of US $100 or the amount you paid Crayon for the Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

This applies to everything you do with the Service: what you generate, what you publish, what you export, and what anyone else does with it afterwards. Crayon supplies the tool; the instructions are yours, and the responsibility for how the results are used sits with you. Nothing here is legal advice, and nothing here removes a right you hold under law that cannot be waived by agreement.

12. General terms

You agree to defend and indemnify Crayon against third-party claims and reasonable costs arising from your User Content, your unlawful use of the Service, or your material breach of these Terms, to the extent permitted by law.

These Terms and the Privacy Policy are the entire agreement between you and Crayon about the Service. If a provision is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service.

Any dispute will be governed by the laws applicable to Crayon Labs Inc, without regard to conflict-of-law rules, and brought in a court with jurisdiction over Crayon, unless mandatory consumer law gives you the right to proceed elsewhere.

We may update these Terms as the Service changes. We will post the revised Terms and update the effective date, and provide additional notice for material changes when required. Your continued use after revised Terms take effect means you accept them.
